Aceh has been the host of Rohingya refugees in the past decade. The location of Aceh is in the North-Western corner of Indonesia, making it an ideal transition point between Myanmar and Australia or Myanmar and Malaysia. The flow of refugees was started in 2009, when small groups of Rohingya refugees arriving in Sabang, a small island on the northern coast of Aceh, and in Kuala Idi, the eastern coast of Aceh. In May 2015, large groups of 1,800 Rohingya people were rescued by Acehnese fishermen during the Andaman Sea Crisis. Recently, 99 Rohingya asylum refugees arrived by boat on the northern coast of Aceh in June 2020. The local fishermen rescued them after being stranded at sea for more than 120 days. There were 31 adult females, 41 unaccompanied girls, 16 adult males, and 11 unaccompanied boys. A few months after, approximately 297 Rohingya refugees were again spotted by local fishermen several kilometers of the coast of Lhokseumawe (North part of Aceh). There were 181 women, 102 men, and 14 children.
All Rohingya refugees in Lhokseumawe (North part of Aceh) were then accommodated in a temporary shelter at Vocational Training Center (BLK) in Meunasah Mee Village, Muara Dua District, Lhokseumawe. The location of the shelter was close to the local neighborhood. However, the local community was not allowed to freely access the shelter for various reasons, including the COVID-19 pandemic, which is currently affecting Aceh. Moreover, this security policy was also enforced to minimize the risks of the Rohingya refugees visited by the smugglers. Unfortunately, the security measure was applied only for visitors. The refugees, on the other hand, are allowed to go outside of the shelter.
Earlier this year, several Rohingya refugees were identified missing from the shelter. It was reported that six Rohingya refugees (M: 2; W:4) were missing from the shelter. Furthermore, an incident involving a missing 7-years-old female Rohingya refugee was also reported. Although, the concerned 7-years-old was brought back by some local people to the shelter 13 days after the incident. The number of the refugee in the accommodation has continuously been decreasing.
Based on the information above, IOM conducted a brief assessment, which resulted in several crucial problems, including a significant risk of the Rohingya refugee being smuggled or trafficked. According to IOM’s assessment, there is a lack of awareness of the Rohingya refugees as well as of the neighboring local community regarding the danger of trafficking in persons and its related crimes. IOM also noticed that there is an absence of comprehensive research on the situation as well as the policy and regulations on the protection of refugees in Indonesia against trafficking in persons. This policy brief shall cover assessment on the current legal framework concerning refugees response and trafficking in persons in Indonesia, analysis on the implementation of legislation/policy in focus areas, research on specific vulnerabilities of refugees and gaps in protection for refugees in relation to transnational crimes such as trafficking in persons, and recommendations to the government of Indonesia, ATTF, and local governments.
The consultant is expected to assess the current and relevant legal frameworks concerning refugees’ response and trafficking in persons in Indonesia, as well as analyse the implementation of legislation/policy in focus area and formulate recommendations for the government of Indonesia at national and local levels.
The consultant will be responsible to conduct the following assignment:
The total duration for this assignment is 3 (three) months.
The quality, targeted and detailed of the work performed as established in above as well as compliance with agreed delivery dates.
The consultant will work under the direct supervision of the IOM Indonesia’s National Program Officer (NPO) for the CT/LMHD unit. As work progress, the consultant will share expected delivery results with the NPO for his review in close coordination with Programme Coordinator – DCR Unit as the budget holder. The NPO will ensure to provide timely comments to the consultant’s work and address any Consultant’s request.
IOM will assist the consultant in:
The Consultant is expected to be based in Jakarta, with potential travel to Medan and/or Aceh.
The proposed consultant(s) should have following competence:
Language: Fluency in English, both oral and written. Fluency in Bahasa Indonesia is an advantage.
The consultant will need to submit technical and financial proposal in ENGLISH.
Each submission must include the following:
Consultants should not assign, transfer, pledge, sub-contract or make other disposition of the consultancy contract or any part thereof, or of any of the Consultant’s rights, claims or obligations under the consultancy contract except with the prior written consent of the Organization, in conjunction with HRM. Therefore, only in limited circumstances, when approved in advance.
The technical proposals of Individual consultant shall be evaluated based on the following criteria and sub-criteria:
